ENTERPRISE, AL – Sawyer Law Firm LLC has filed a personal injury lawsuit against Lowe’s Home Center’s, Inc. on behalf of an Alabama woman who suffered a severe neck injury when she was struck by falling merchandise in the store. The woman was shopping in the Lowe’s store when a large, rolled-up area rug fell from a high shelf and struck her in the head. As a result of the incident, the woman had to undergo a cervical fusion.
“This is a hazard that has developed with the increase of large warehouse retail stores”, says Attorney J.P. Sawyer. “These large warehouse stores operate on the formula that it is more efficient, less expensive and more profitable to warehouse as much merchandise as possible on the sales floor, rather than in off-site warehouses,” Sawyer says. “High stacking” is based on the principle that it is cheaper to ‘go up’ than to ‘go out’”. Unfortunately, this often jeopardizes customer safety.
”Our investigation revealed that in other Lowe’s stores the rugs were stacked and secured by a retention strap”, Sawyer says.“Unfortunately, this store chose not to implement this important safety precaution.”
